Acceptance and Jurisdiction

By using this web site, you agree that you have read, understood, and will abide and be bound, by the terms of the User Agreement. If you do not agree to the User Agreement, please do not use Yep Energy’s web site. The User Agreement shall be governed in all respects by the laws of Harris County in the state of Texas without regard to the conflict or choice of law rules thereof. Courts sitting in Harris County in the state of Texas, federal and state, shall have exclusive jurisdiction over any dispute arising hereunder.

Yep Energy Web Service

In order to use Yep Energy s automatic and/or monthly online payment option (the "Service"), you are required to complete the enrollment process by providing Yep Energy with complete and accurate information as prompted by the registration enrollment form. By completing the enrollment form, and clicking the "I Agree" button, you agree to the User Agreement regarding your use of the Yep Energy web access.

When initiating a payment, you authorize Yep Energy to remit funds on your behalf from your designated savings, checking, and/or credit card account(s) (your "Payment Account") in accordance with your banking instructions.

Bill payments are considered pending from the time you enter your payment information until such payments are fully processed by your financial institution. Bill payments will be considered paid only after the Service receives a remittance file from your financial institution indicating a successful payment.

Yep Energy will provide up to six (6) months of account history through the Service. As a condition of your use of the Service, you will not use the Service for any purpose that is not authorized by the User Agreement. You may not interfere with any other party's use of the Service. You may not attempt to gain unauthorized access to the Service through any means.

In order to use the Service, you are required to complete the registration process by providing Yep Energy with complete and accurate information as prompted by the applicable registration form provided. Your user ID and password will be selected by you during the enrollment process. You will use your user ID and Password to access your Yep Energy electric service account. You agree not to give or make available your personal identification information or other means to any unauthorized individuals to access the Service.

Except as provided herein, you are responsible for all bill payments made through the Service using your personal identification information for access and you are entirely responsible for any and all activities that occur through the use of your personal identification information with the Service. You could be held liable for losses incurred by Yep Energy or another party due to someone else's use of your personal identification information or your Payment Account with the Service. Yep Energy will not be responsible for any loss you may incur as a result of someone else's misuse of your personal identification information, banking information, credit card information, or your Payment Account through the Service either with or without your permission.

By completing the enrollment form, you are authorizing Yep Energy to display billing and payment information on its secure internet site. Yep Energy may disclose information to third parties about your Yep Energy electric service account, your Payment Account, and/or the transactions you make. Please see our Privacy Policy for more specific information regarding how we may use and/or disclose your information to third parties.

There is no charge for using the Yep Energy online service; however, any fees associated with your Payment Account and/or your Yep Energy electric service account will continue to apply. You are responsible for any and all telephone access fees and/or internet service fees that may be assessed by your telephone and/or internet service provider.

If Yep Energy is unable to complete the transaction through the Service for any reason associated with your Payment Account(s) (for example, there are not sufficient funds in your checking account and/or your credit card is denied), the transaction will not be completed. Late fees and/or returned payment fees may apply.

You are responsible for keeping your correct and current email address information in your customer profile. You agree to promptly notify Yep Energy at least ten (10) business days in advance of any change in your banking status. This must be done through the Service and/or as we may otherwise require. Each time any change is made by you to your enrollment information, you shall notify Yep Energy.

If a Yep Energy notification to you is returned to Yep Energy as "undeliverable", such will be considered an unsuccessful notification. Two additional attempts will be made before further attempts at notification are abandoned.

In the event you wish to discontinue the Service, you can do so by un-registering through the Service and/or by contacting Yep Energy’s Customer Care Department.

Yep Energy may terminate the Service at any time and/or revoke your right to use this service for any or no reason. Neither termination nor discontinuation shall affect your liability or obligations under the User Agreement and/or the Terms of Service Agreement governing your electric service through Yep Energy .

Termination of the Service terminates your electronic billing and payment services but does not cancel your electric service with Yep Energy. If you cancel the Service, Yep Energy will mail you a paper bill. If you wish to switch your electric service from Yep Energy to another retail electric provider, please contact a customer care representative at 1-866-937-5937.

Your enrollment in the Service may not be fulfilled if the Service cannot verify your identity or other necessary information.

In the event of a dispute regarding the Service, you agree to resolve the dispute by looking to this User Agreement and the Terms of Service Agreement which govern your electric service with Yep Energy . You agree that the User Agreement and the Terms of Service Agreement constitute the complete and exclusive statement of the agreement between you and Yep Energy regarding the Service.

Updates

Yep Energy reserves the right to change the User Agreement at any time, and will immediately post the updated information on its web site. You are responsible for regularly reviewing the User Agreement. Your continued use of the Service shall constitute your agreement to the User Agreement and all amendments to the User Agreement.
